These terms govern the referral programme offered by LA VRAC ATTITUDE (hereinafter "the Company"), publisher of the Turtle Shell brand, in connection with sales made on https://turtleshell.eu.
The Company offers a referral programme rewarding any customer ("the Referrer") who has purchased a Turtle Shell lock. For each first purchase made by a nominated third party ("the Referee"), the Referrer receives a discount of 10,00 € refunded to their original payment method. This discount entitlement is limited to three occurrences per Referrer per order.
For the Referrer:
— Have placed a confirmed and paid order on turtleshell.eu or a marketplace.
— Not be subject to any dispute, chargeback or refund on their order.
— Not be engaged in any commercial activity reselling Turtle Shell products.
— A maximum of 3 referrals per order is permitted.
For the Referee:
— Have placed a confirmed and paid order on turtleshell.eu.
— Be a new buyer (first order on the site).
— Provide, when placing the order, a valid email address and the Referrer's order number.
— Keep the product beyond the statutory withdrawal period of 30 calendar days from receipt.
— Not initiate any return, dispute or chargeback.
The referral programme is offered for limited periods defined by the Company and communicated on the site. The Company reserves the right to suspend, modify or terminate the programme at any time, without notice, for any future period not yet commenced. Referrals already qualified before the suspension remain due under the terms in force at the time of purchase.
The discount of 10,00 € is paid to the Referrer as follows:
— The refund is made to the payment method used for the Referrer's order, via Stripe or via the marketplace on which the Referrer placed their order.
— Payment is made within 10 working days following the expiry of the Referee's withdrawal period (i.e. at the earliest 40 days after the Referee receives their parcel).
— No advance, set-off or early payment will be made.
— In the event of a technical impossibility of refunding to the original payment method (expired card, etc.), the Company will contact the Referrer to agree on an alternative solution.
The Company reserves the right to verify the validity of each referral and to refuse payment of the discount in the following cases (non-exhaustive list):
— Incorrect or unverifiable referral information (unknown Referrer email or order number).
— Suspicion of fraud, self-referral or fictitious orders.
— Exceeding the limit of 3 referrals per order.
— Return, dispute or chargeback initiated by the Referee before expiry of the withdrawal period.
— Non-compliance with any of the conditions in this article.
In the event of refusal, the Referrer will be notified by email within a reasonable timeframe.
In the context of the referral programme, the Referrer's email address is collected and processed by the Company solely for the purposes of verification and payment of the discount, in accordance with the GDPR. This data is not shared with third parties for commercial purposes. The Referrer has the right to access, rectify and delete their data by contacting .
The Company cannot be held liable for any inability to verify referral information due to an input error by the Referee, nor for any potential tax implications for the Referrer (the discount received may, depending on applicable legislation, be subject to income declaration — the Referrer is advised to consult the relevant tax authorities).
These terms are governed by French law. Any dispute relating to the referral programme will first be subject to an attempt at amicable resolution. If no agreement is reached, the dispute will fall within the jurisdiction of the Commercial Court of Grenoble.
